HeyCallAI provides an AI-powered phone receptionist service that:

  • Answers incoming phone calls on your behalf
  • Transcribes and summarizes conversations
  • Provides sentiment analysis and action items
  • Handles SMS messages
  • Integrates with third-party services via Zapier

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm others
  • Send spam or unsolicited communications
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service for illegal telemarketing or robocalling

5. Subscription and Payment

5.1 Pricing

The Service is offered on a subscription basis. Current pricing is displayed on our website. We reserve the right to change pricing with 30 days notice.

5.2 Billing

Subscriptions are billed in advance on a monthly or yearly basis. All payments are processed securely through Stripe.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by HeyCallAI and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

You retain ownership of any content you provide to the Service (call recordings, messages, etc.). By using the Service, you grant us a license to process this content as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

AI-generated transcriptions and summaries may contain errors. You should verify critical information independently.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYCALLAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless HeyCallAI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
